These Terms & Conditions apply to the use of the NyxAbbey website and to purchases made through our online store. By placing an order, you agree to these Terms & Conditions. Please read them carefully before completing your purchase.
NyxAbbey is operated by Eclectic Tales Studio, a sole proprietorship registered in Belgium. Full business and contact information is available in our Legal Notice.
Products
NyxAbbey offers apparel, accessories, jewelry and lifestyle products featuring original designs and artwork. Many of our products are produced on demand through selected production and fulfillment partners.
We make every effort to display product colors, details and dimensions as accurately as possible. However, slight variations may occur due to screen settings, materials and production methods.
These variations do not affect your statutory rights where a product is defective, damaged or does not conform to the order.
Orders
After placing an order, you will receive an order confirmation at the email address provided during checkout.
Orders may enter production shortly after they are placed. If you need to request a modification or cancellation, please contact us as soon as possible.
Where production has already begun, we may not be able to modify or cancel the order before dispatch. This does not affect any statutory right of withdrawal or other consumer rights that apply to your purchase.
We reserve the right to cancel an order where necessary, including in cases of payment failure, suspected fraud, incorrect pricing or product unavailability. If payment has already been received for an order that we cancel, the applicable amount will be refunded.
Prices & Taxes
All prices on the NyxAbbey website are displayed in U.S. Dollars (USD) unless otherwise stated.
Applicable taxes and charges will be displayed as required during the purchasing process.
Depending on the destination country, an order may also be subject to import duties, taxes or customs charges imposed by local authorities. Where these charges are not collected at checkout, they may be payable by the recipient.
If your payment method uses a currency other than USD, your bank or payment provider may apply currency conversion or international transaction fees.
Payment
Payment must be completed using one of the payment methods available at checkout.
Payments are securely processed by our third-party payment providers. NyxAbbey does not store or have access to your full payment card details.

Shipping & Delivery
Orders are produced and shipped through our fulfillment network. Processing and delivery times shown on our website are estimates unless a specific delivery commitment is expressly stated.
Delivery times may be affected by circumstances outside our reasonable control, including carrier disruptions, customs procedures, severe weather or other exceptional events.
Customers are responsible for providing complete and accurate delivery information when placing an order. Please contact us as soon as possible if you notice an error in your shipping information.
Your statutory rights regarding delivery remain unaffected.

Right of Withdrawal & Returns
Where applicable under consumer law, customers purchasing online may have the right to withdraw from their purchase within 14 days of receiving the goods, without providing a reason.
Certain products may be exempt from the right of withdrawal, including goods made to the consumer’s specifications or clearly personalised. Any applicable exceptions will be communicated where required.

Nothing in these Terms & Conditions limits or affects any mandatory consumer rights available under applicable law.
Damaged, Defective or Incorrect Products
If an item arrives damaged, defective or incorrect, please contact us as soon as possible and provide your order details and, where appropriate, photographs showing the issue.
We will assess the issue and provide an appropriate remedy in accordance with applicable consumer law.
Statutory rights relating to defective or non-conforming goods are separate from the right to change your mind about a purchase. Consumers in the EU benefit from a minimum legal guarantee for goods.

Intellectual Property
Unless otherwise stated, the NyxAbbey name, branding, original artwork, designs, graphics, photographs, text and other original website content are protected by applicable intellectual property laws.
Content owned by NyxAbbey or Eclectic Tales Studio may not be reproduced, distributed, modified, sold or used for commercial purposes without prior written permission.
Third-party trademarks, product names or other intellectual property remain the property of their respective owners.
Website Use
You agree not to misuse this website, interfere with its operation, attempt unauthorized access to its systems or use its content for unlawful purposes.
We may temporarily restrict access to parts of the website where reasonably necessary for maintenance, security or technical reasons.
Limitation of Liability
Nothing in these Terms & Conditions excludes or limits any liability that cannot legally be excluded or limited, or affects any mandatory consumer rights available under applicable law.
To the extent permitted by law, NyxAbbey and Eclectic Tales Studio are not liable for indirect or consequential losses that were not reasonably foreseeable at the time the contract was entered into.

Personal information submitted through the NyxAbbey website is handled in accordance with our Privacy Policy.
Payment information is processed securely by our payment providers and is subject to their respective privacy and security practices.
Changes to These Terms
We may update these Terms & Conditions from time to time to reflect changes to our services, business practices or applicable requirements.
The Terms applicable to an order are those in effect when the order is placed. Changes published after an order has been placed do not retrospectively alter the contractual terms applicable to that order, except where required by law.
Governing Law
These Terms are governed by Belgian law, without depriving consumers of any mandatory protections available to them under the applicable laws of their country of residence.
